Welcome to the French Gourmet Store Affiliate Terms & Conditions. This Agreement contains the complete terms and conditions that apply to an individual's or entity's participation in the French Gourmet Store Affiliate Scheme.

By completing the application process via RomanClick you acknowledge that you have read, understood and agree with the following terms and conditions.

1. Joining the French Gourmet Store Affiliate Program

By registering your website with RomanClick you will automatically become an affiliate and are bound by the terms of this agreement. Your participation in the program is solely for the purpose of legally advertising the French Gourmet Store website to receive a commission on products purchased by your referral individuals.

2. Revocation of Affiliate Status

Your affiliate application and status in the program may be suspended or terminated for any of the following reasons:

• Inappropriate advertisements
• Spamming
• Advertising on sites containing/promoting illegal activities
• Violation of intellectual property rights.

We may also reject your application if we determine (at our sole discretion) that your website is unsuitable for the Affiliate programme. Unsuitable sites include, but are not limited to, those that:

• Promote sexually explicit materials
• Promote violence
• Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age

Please note that if we accept your application and your site is thereafter determined (at our sole discretion) to be unsuitable for the Programme, we may terminate this agreement at any time.

3. Affiliate Links

After you have enrolled as an afflilate, you can provide one or more links from your site to our site. We will provide you with special link formats such as banners designed for tracking and reporting for all links between your site and our site. You will be solely responsible for properly utilising the link formats. We do not accept any responsibility for the incorrect use of the special links / link formats and therefore we shall not be accountable for any loss of fees as a result of your errors.

4. Affiliate Tracking

When one of your users clicks through your affiliate link, a cookie is set in their browser that contains your affiliate username. Also, their IP address is tracked in the database along with your affiliate name. When this person decides to buy a product, the script will look for this cookie and/or try to match their IP address to identify the affiliate who will be awarded the commission. Visitors sent through your affiliate link may make a purchase later in time and the commission will still be awarded if the cookie is present in their browser and/or they are using the same IP address as the one logged in the database.

5. Order Processing

French Gourmet Store will process Product orders placed by customers who follow referral links from your site to the French Gourmet Store site. We reserve the right to reject orders that do not comply with any requirements that we periodically may establish. We will be responsible for all aspects of order processing including processing payments, cancellations and returns and customer service. We will track sales made to customers who purchase products using referral links from your site to our site and will make available reports summarising this sales activity. The form, content and frequency of the reports may vary from time to time at our discretion. To permit accurate tracking, reporting and fee accrual, you must ensure that the referral links between your site and our site are properly formatted. We will not be liable for paying referral fees on purchases that are not correctly tracked and reported because the links between your site and our site are not properly formatted.

6. Referral Fees

Referral fees are 8% of product value or orders received through affiliate referral links. We pay our affiliates in UK Pounds by Cheque or Paypal. Your continuing participation in the program will constitute your acceptance of any change. Payments are made when your total commissions are £10 or more. If your commissions total is less than £10, the current month's commissions are rolled over to the next month, until your amount due is at least £10.00.

Subject to the terms and conditions of this Agreement, you will be paid commission for each customer referred through the French Gourmet Store link on your site who successfully makes a purchase. Referral fees are paid on such products after order, payment and shipping have occurred. If it is later found that the customer's purchase was refunded, we retain the right to withhold any payments to you resulting from that individual's purchases. The affiliate scheme relies on cookies to track customers. If for whatever reason, the customer isn't using cookies, or the cookie expires or the customer deletes the cookie, they cannot be tracked and you will not earn commission for any sales that customer may make. Our cookies are set to expire after ninety days. If at any time the commissions owed to you become less than the total deductions due to refunds as mentioned above the difference shall be immediately payable to French Gourmet Store.

Commission may not be paid to an affiliate if the details we hold for that affiliate are not accurate. It is the affiliate's responsibility to make sure that the French Gourmet Store is notified of any change in their details such as email or postal address. We also reserve the right to cancel commission payments if we believe that there have been any fraudulent attempts to use the service.

7. Liability

French Gourmet Store will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program or our website. We do not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program and our website will be error-free and we will not be liable for any interruptions or errors.

8. Limited License
French Gourmet Store grants you a non-exclusive, non-transferable, non-sub licensable, revocable right to use our logos, text and banners for which we grant express permission, solely for the purpose of identifying your site as an affiliate scheme participant. You agree that you will not engage, participate or otherwise become involved in any activity or course of action that diminishes and/or tarnishes the image and or reputation of French Gourmet Store. If this is deemed as such we retain the right terminate this agreement.

9. Terms of the agreement

These terms will begin upon your signup with the affiliate program and will end when your affiliate account is terminated. The terms of this agreement may be modified by us at any time. If any modification to the terms is unacceptable to you, your only choice is to terminate your affiliate account.

Either you or French Gourmet Store may terminate this Agreement at any time, with or without cause, by giving the other party written or emailed notice of termination. You are only eligible to earn referral fees on sales occurring during the term of this agreement only. We may withhold your final payment to ensure that the correct amount is paid. Your site is subject to periodic review. If we determine at any point after acceptance into our scheme that your site is not suitable for the scheme, we may unilaterally end the status of your site as an Affiliate.

Upon termination of this Agreement, you must immediately cease use of, and remove from your site, all links to our site and all French Gourmet Store trade names, banners and logos and any other material used by you in connection with the Programme.

10. Modification

We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting a new agreement on our site. Your continued participation now, or within thirty days following the posting notice of any changes in these terms and conditions, will constitute a binding acceptance by you of such rules, changes or modifications. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the scheme following our modifications will constitute a binding acceptance of the change.
